DMCA / Copyright Policy

Pedrablanca Digital Group LLC ("Company", "we", "us", "our"), operator of Restackd (restackd.com), respects copyright and intellectual property rights. This policy explains how we handle copyright infringement claims under the Digital Millennium Copyright Act (DMCA) and related laws. Restackd is a SaaS platform that provides creators with tools to build, publish, and sell digital products through their own storefronts. We provide a safe harbor process for copyright owners to report infringing content.

1. Designated DMCA Agent

Pedrablanca Digital Group LLC has designated the following agent to receive copyright infringement notices under 17 U.S.C. § 512(c):

2. How to File a Takedown Notice

If you believe that content hosted on Restackd infringes your copyright, you may submit a written takedown notice. To be valid under the DMCA, your notice must include all of the following (17 U.S.C. § 512(c)(3)):

2.1 Required Elements of a Takedown Notice

  • ·Your physical or electronic signature
  • ·Identification of the copyrighted work(s) you claim are infringed, or if multiple works are covered by a single notice, a representative list of such works
  • ·Identification of the material that you claim is infringing, including its location on the platform (provide specific URLs, product IDs, or other precise descriptions)
  • ·Your contact information: name, address, telephone number, and email address
  • ·A statement that you have a good faith belief that the use of the material is unauthorized by you, your agent, or the law
  • ·A statement that the information in your notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner

2.2 Where to Send Takedown Notices

Send your complete DMCA takedown notice to:

Include all elements listed in Section 2.1 above. Incomplete notices will be rejected.

3. Our Response to Takedown Notices

Upon receipt of a valid takedown notice, Restackd will:

  • ·Promptly investigate the claim and verify that all required information has been provided
  • ·Disable access to the allegedly infringing material or remove it from the platform if the claim appears valid
  • ·Notify the user who uploaded the content that their material has been removed or disabled, and provide them with a copy of your takedown notice
  • ·Preserve evidence and respond to legal requests for information about the infringement claim
  • ·Respond to you with confirmation once the material has been removed or disabled

We typically respond to complete, valid takedown notices within 5-10 business days, though response times may vary depending on the complexity of the claim and our operational capacity.

4. Counter-Notification Process

If you are a Restackd user and your content has been disabled or removed due to a takedown notice, you may submit a counter-notification if you believe the material was removed in error or that you have authorization to use the material.

4.1 Requirements for a Counter-Notification

To submit a valid counter-notification under 17 U.S.C. § 512(g), you must provide all of the following:

  • ·Your physical or electronic signature
  • ·Identification of the material that was removed or disabled, and where it was located before removal
  • ·A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification
  • ·Your name, address, telephone number, and email address
  • ·A statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located, and that you will accept service of process from the person who provided the original takedown notice

4.2 Submitting a Counter-Notification

Send your counter-notification to the same address as takedown notices:

Upon receipt of a valid counter-notification, Restackd will notify the original claimant and wait 10-14 business days before restoring your material, unless the claimant notifies us of legal action.

5. Repeat Infringer Policy

In accordance with the DMCA and our commitment to protecting intellectual property rights, Restackd maintains a repeat infringer policy:

  • ·Users who have had content removed for copyright infringement may appeal once and will be given the opportunity to remove the content themselves or submit a counter-notification
  • ·Users with multiple confirmed copyright infringement violations (typically 3 or more substantiated claims) will have their accounts suspended or permanently terminated
  • ·We maintain records of infringement notices to identify patterns of repeat infringement
  • ·Serious or egregious violations (e.g., wholesale copying of protected works, commercial piracy) may result in immediate account termination without prior notice

6. Good Faith Statement

We implement this policy in good faith. Specifically:

  • ·We use reasonable efforts to notify users of copyright claims promptly and provide them the opportunity to respond
  • ·We do not arbitrarily or excessively remove content, and we carefully review each takedown notice to ensure compliance with DMCA requirements
  • ·We maintain balanced policies that protect both copyright owners and users' fair use rights
  • ·We preserve evidence and cooperate with law enforcement investigations related to copyright infringement
  • ·We do not knowingly host or promote content that violates copyright or intellectual property rights

7. Fair Use & User Rights

We recognize that fair use and other legal exceptions to copyright exist. Users have the right to:

  • ·Create transformative works (parody, criticism, commentary) that incorporate copyrighted material within the bounds of fair use
  • ·Use material they have a license or permission to use, even if the copyright holder has not authorized it on Restackd
  • ·Share their own original work without fear of false DMCA claims

If you believe your content was incorrectly removed as infringement, you have the right to submit a counter-notification (see Section 4). We will not retaliate against users for good-faith counter-notifications.

8. Fraudulent & Bad Faith Claims

Submitting a DMCA notice with materially false information, or submitting a takedown notice for material you do not own or have no authorization to protect, may expose you to legal liability, including damages under 17 U.S.C. § 512(f). Restackd does not assist in facilitating fraudulent claims and will take appropriate action, including account suspension and disclosure to law enforcement, if we detect patterns of bad faith notices.

9. Non-Copyright Intellectual Property Claims

This DMCA policy applies only to copyright infringement claims. For other intellectual property issues, such as trademark infringement, patent claims, or trade secret violations, please contact us at legal@restackd.com with details of your claim and we will evaluate it separately.

10. Privacy in DMCA Proceedings

When we receive a takedown notice, we may disclose your identity and contact information to the user whose content is being removed, and vice versa. This is standard practice in DMCA proceedings and is necessary for the counter-notification process. If you have privacy concerns, consult with an attorney before submitting a takedown notice.
